Generally
A purchase from the Galleri RKK webshop is governed by the following standard terms of sale for consumer purchases of goods over the Internet. Purchase is meant here the sale of goods to consumers who do not primarily act as part of business activity and when acts in business activities with the sale of goods over the internet. Sales to consumers are regulated in the Consumer Purchases Act (Norwegian: Forbukerkjøpsloven) and the Cancellation Act (Norwegian: Angrerettloven).
Agreement
The agreement between the buyer and the seller consists of the information the seller gives about the purchase in the ordering solution in the online store (including information on the nature of the goods, quantity, quality, other properties, price and delivery conditions), any direct correspondence between the parties (for example e-mail) and these terms of sale.
In the event of a conflict between the information given by the seller about the purchase in the ordering solution in the online store, direct correspondence between the parties and the terms of the sales conditions, direct correspondence between the parties and the information given in the ordering solution precedes the sales conditions, provided that this does not conflict with binding legislation.
The Parties
The seller is the company that is stated at the bottom of the webshop. The customer is the person who makes the order.
Pricing and Taxes
There is no Norwegian VAT (MVA) on art sold directly from the artist as is the case for the Galleri RKK website (mval § 3-7).
For art priced above NOK 2000,- (shipping excluded) the 5% Norwegian Art Tax applies.
Shipping is included in the price shown on the website, and so is the 5% Norwegian Art Tax.
Additional taxes may apply outside Norway.
Sourcing
The agreement is binding on both parties when the buyer’s order is received by the seller. However, a party is not bound by the agreement if there has been a typing or key error in the offer from the seller in the ordering solution in the online store or in the buyer’s order, and the other party realized or should have realized that such a mistake existed.
Order Confirmation
You will receive an order confirmation email immediately after the purchase is completed. It is recommended that the buyer verifies that the order confirmation corresponds to the order with respect to the number, type of product, price, etc. If there is not correspondence between the order and the order confirmation, the buyer should contact the seller as soon as possible.
Payment
Payment on the website shop is done using PayPal (this is payment with Visa-, MasterCard-, Discover- and American Express). No artwork will be sent from me until PayPal confirms your payment. In case of a dispute about the order, PayPal will help to arrive at a solution.
When paying by credit card, Finansavtaleloven kap.3 § 54 apply.
Purchases may also be done outside the web solution by direct contact, via e-mail etc. The payment is then done via a Payal.Me-link (PayPal.Me/GalleriRKK) or using VIPPS (#570657) / AliPay (to be established), and you will have to pick up your product yourself or provide me with your name and address for sending.
Delivery With
Delivery of the artwork ordered from the website www.gallerirkk.com – or from direct contact – to you takes place in the manner, at the place and until the time specified in the ordering solution in the online store. If the delivery time is not stated in the ordering solution or e-mail that comes with the order confirmation, I – the seller – shall deliver the art to you – the customer – within a reasonable time and no later than 30 days after the order from you. Most giclées are made on demand, and I will want to let it rest for some days before I put it in the tube or box for postage. The package will then be submitted to your postal address using Bring. In Norway you will have to pick up the package at your nearest post office if home delivery is not specified. Tracking is available for most of Europe and North America. For the rest of the world and for more expensive paintings, other postage solutions may be chosen. You will be informed when the package is sent and how.
The Risk of the Item
The risk of the goods passes to the buyer when package is taken over by the buyer in accordance with the agreement. If the delivery time has arrived and the buyer fails to take over an item placed at his or her disposal under the agreement, the buyer nevertheless has the risk of loss or damage due to the properties of the item itself.
Right of Withdrawal
Due to the Cancellation Act (angrerettloven) in EEA (EØS) regarding sales of goods as a distance contract or off-premises contract, you are entitled to cancel/withdraw from the contract within 14 days after you have received your purchased artwork, using a standardised form (cancellation form) that is enclosed with the artwork. You – the customer – will have to pay the costs of returning the artwork you have bought. The artwork must be received by me without undue delay and latest within 14 days from the date I was informed about the cancellation. Also the artwork must be in the original condition without damages. As soon as the condition of the returned artwork is approved by me, your original payment will be returned. If there are any damages or the artwork is not received by me, the cancellation will be rejected.
No Warranties
This Website is provided “as is,” with all faults, and Galleri RKK / MetaForsk Rakel Kristin Kanestrøm express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.
Limitation of Liability
In no event shall Galleri RKK / MetaForsk Rakel Kristin Kanestrøm be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. Galleri RKK / MetaForsk Rakel Kristin Kanestrøm shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
Indemnification
You hereby indemnify to the fullest extent Galleri RKK / MetaForsk Rakel Kristin Kanestrøm from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Variation of Terms
Galleri RKK / MetaForsk Rakel Kristin Kanestrøm is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
Assignment
The Galleri RKK / MetaForsk Rakel Kristin Kanestrøm is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
Entire Agreement
These Terms constitute the entire agreement between Galleri RKK / MetaForsk Rakel Kristin Kanestrøm and you in relation to your use of this Website, and supersede all prior agreements and understandings.
Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of Norway, and you submit to the non-exclusive jurisdiction of the courts of Norway for the resolution of any disputes.
